Responsibility

That Wild Idea (TWI) will provide educational and creative enrichment for TWI Photography Tours, Workshops and Tailor Made Tours as outlined on this website as a sponsoring organization and has qualified professional guides, instructors and tour operators to organize and administer TWI Photography Tours, Workshops and Tailor Made Tours. The designated tour operator(s), in turn, acts only as an agent for any transportation carrier, hotel, ground operator, or other suppliers of services connected with these tours (“other providers”), and the other providers are solely responsible and liable for providing their respective services. The passenger tickets in use by the carriers shall constitute the sole contract between the carriers and the passenger; the carriers are not responsible for any act, omission, or event during the time participants are not aboard their conveyances.

TWI and its designated tour operator and tour administrator shall not be held liable for (A) any damage to, or loss of, property or injury to, or death of, persons occasioned directly or indirectly by an act or omission of any other provider, including but not limited to any defect in any aircraft, watercraft, or vehicle operated or provided by such other provider; and (B) any loss or damage due to delay, cancellation, or disruption in any manner caused by the laws, regulations, acts or failures to act, demands, orders, or interpositions of any government or any subdivision or agent thereof, or by acts of God, strikes, fire, flood, war, rebellion, terrorism, insurrection, sickness, quarantine, epidemics, theft, or any other cause(s) beyond their control. The participant waives any claim against TWI and/or its designated tour operator and tour administrator for any such loss, damage, injury, or death.

By registering for a TWI Photography Tour, Workshop and Tailor Made Tour, the participant certifies that he/she does not have any mental, physical, or other condition or disability that would create a hazard for him/herself or other participants; and they are aware of any associated risks created by field locations, activities and weather; that they agree to follow the instructors’ directions, particularly in matters of personal and group safety, including but not limited to the importance of hydration, need for nutritious snacks, altitude sickness, exhaustion, leave no trace, sunscreen, bug dope, danger of overhangs, footing, vehicle safety, boat safety, hot air balloon safety, helicopter safety, ferry safety, common-sense safety, respect for others, etc. TWI and its designated tour operator reserve the right in their sole discretion to accept, decline to accept, or remove any participant on a TWI Photography Tour. Workshop or Tailor Made Tour. TWI and the tour operator reserve the right, without penalty, to make changes in the published itinerary whenever, in their judgment, conditions warrant or if they deem it necessary for the comfort, convenience, or safety of participants.

Neither TWI, its designated tour operator nor its tour administrator shall be liable for any air carrier’s cancellation penalty incurred by the purchase of a nonrefundable ticket to or from the participant’s PWA Photography Adventure Tour, Workshop or Tailor Made Tour departure city. Baggage and personal effects are at all times the sole responsibility of the participant.

Terms & Conditions

Basis of Rates: All prices are based on two persons sharing a room. All prices and fares are quoted in GBD pound sterling. The rates are based on current tariffs and are subject to change due to unforeseen circumstances. While we will do everything possible to maintain the listed prices, if it is necessary to levy a surcharge, we reserve the right to do so, and notification will be given at the time of final invoicing.

Eligibility: Participants in a TWI Photography Tour, Workshop and Tailor Made Tour must be 18 or over.

Included in Tour Cost: Accommodations and meals as indicated in the itinerary (B = breakfast, L = lunch, D = dinner); educational materials; pre-departure information; and sightseeing noted as included in the itinerary, unless otherwise noted on the itinerary page; ground transportation during the tour; transfers to and from group flights where applicable; services of TWI experts, lecturers, guides, tour manager, and any other staff. Please note: the “B, L, D” notations apply to the period during the tour only and do not include any meals on flights to/from the trip. Internal airfare is included on some international tours as indicated in the itinerary. Note: Although breakfasts may be listed as included, some hotels do not offer packages that include breakfast. TWI, its partners, travel agents or tour operators always book the best accommodations based on the group and never compromise the quality of the hotel for the benefit of a breakfast package.

Not Included: Air transportation and related fees (except as indicated in the itinerary); activities noted as excursions and/or noted as optional in the itinerary; gratuities, unless otherwise noted on the itinerary page; passport and visa expenses; baggage/accident/cancellation insurance; personal expenses, such as laundry, telephone calls, and alcoholic beverages; and any other items not specifically noted as included.

Accommodations: TWI reserves the right to change accommodations based on our final attendance count, pricing and other factors that might influence our decision. We typically stay in hotels in the 4-star category. Not all destinations offer these types of properties. We look for unique hotels which offer cultural, historic and/or authentic features. Depending on the size of the group, smaller boutique hotels may have limited room inventory. In some countries or in remote locations, we may be limited to hotels, lodges, bed and breakfasts or branded chain hotels of lesser quality. If we decide to operate a tour with three (3) or fewer guests, we reserve the right to select accommodations that work within our budget. This could mean that we downgrade the hotels to a 3-star category. Although this rarely happens, we reserve the right to potentially make these changes. Breakfast is included only if included in our room rates.

Single/Shared Accommodations: A limited number of single rooms/cabins are available at an extra cost on a first-come, first-served basis. We will assist persons requesting a roommate. Participants will be notified if a suitable roommate is not available, in which case the single rate will be charged.

Early Arrival and Late Departure Accommodations: We offer our guests the convenience of booking early arrival and late departure hotel rooms. We base the price of these accommodations on an average amount we expect to pay for the hotel room in any of the hotels we may consider using. It is not our intention nor our objective to profit from these hotel bookings, however, prices are listed years in advance so the price we pay can be +/- the actual price listed. Rooms are typically in the superior or deluxe categories. We highly recommend that our guests reserve early arrival or late departure rooms through TWI for their own convenience and the convenience of the group.

Payments, Cancellations and Refunds: To reserve space on a TWI Photography Tour or Workshop, a deposit is required. Final payment is due no later than 120 days prior to departure. Balance payments must be made via the PayPal invoice that we send. Your reservation may be cancelled if full payment has not been received by 120 days prior to departure. For reservations made within 120 days of the departure date, full payment is required within 5 business days of the reservation. All cancellation notices must be received via email and will become effective as of the date of the postmark (standard mail or electronic).

Cancelling more than 120 days before the start of your tour means your balance will not be payable, but you will forfeit your deposit unless we can fill your spot. If you cancel your tour having already paid the remaining balance of the tour cost, the following charges will be payable:

120 to 90 days before the start of the trip, cancellation fees are 25% of your tour fee balance (you will also forfeit your initial deposit)

89 to 60 days before the start of the trip, cancellation fees are 50% of your tour fee balance (you will also forfeit your initial deposit)

59 to 30 days before the start of the trip, cancellation fees are 90% of your tour fee balance (you will also forfeit your initial deposit)

0 to 29 days before the start of the trip, there is no refund (you will also forfeit your initial deposit).

There will be no refunds for services and activities relating to the tour/workshop that are voluntarily not used.

Transfer charges and fees incurred on accepting and/or refunding payments will be deducted from the refund.

Should you fail to join a tour, join it after departure or leave it prior to its completion, no tour fare refund will be made. There will be no refunds from TWI for any unused portions of the tour. The above policy applies to all travel arrangements made via TWI.

If a tour is cancelled prior to departure, TWI will provide you with a full refund of monies paid; except in the event that the cancellation is due to a significant event that makes it infeasible to operate the tour as planned, in which case the tour operator will provide you with a refund and/or credit toward a future TWI Photography Tour, Workshop or Tailor Made Tour equivalent to monies paid to the tour operator. If we cancel the trip in progress, you will receive a prorated refund based on the number of days not completed on the tour. We will not be responsible for any refund for nonrefundable airline tickets or for any airline tickets purchased by the passenger directly from an airline or travel agent. All refunds will be processed within 7-10 business days. We strongly suggest travel insurance to protect your investment.

Weather: We reserve the right to cancel, reschedule or re-route a TWI Photography Tour, Workshop, Tailor Made Tour up until last minute, due to inclement or unsafe weather conditions, safety or other uncontrollable circumstances.

Travel Insurance: TWI strongly recommends purchasing travel insurance that protects you and your investment in the event of a sudden emergency before or during your trip and coverage for trip cancellation or interruption, illness, injury, and damage, loss or theft of baggage, as well as emergency assistance. Travel insurance must be secured and paid for at least 30 days prior to departure.

Photographer Leaders: The itineraries and staff presented on this website are subject to modification and change by TWI or its designated tour operator. Every reasonable effort will be made to operate programs as planned, but alterations may still occur after final itineraries are sent. TWI makes every attempt to provide photographic opportunities during the best possible light, but this is often compromised by daily itineraries and travel schedules. Since the best light is just after sunrise and just before sunset when the sun is low, it is impossible to visit all locations during these limited hours. TWI makes every attempt to instruct throughout the adventure. It is important that you arrive with a working knowledge of your camera’s settings. TWI does not provide any classroom instruction unless specifically stated in the itinerary. Instructions are conducted on site using walk-n-talk techniques. Don’t be afraid to ask questions and seek out your leader when you need help. TWI makes no guarantees that you will become a better photographer.

Health Requirements: You must be in good physical and mental health. You must be able to maintain the pace of the group throughout the tour. Any physical condition, diet, or treatment requiring special attention must be reported in writing when you register. Failure to participate in daily activities due to physical or mental health will not result in any refund. For special dietary requirements, we do our best to convey this information to restaurants and food establishments, but the communication of these requirements to restaurants and food establishments is ultimately your responsibility. TWI reserves the right to refuse attendance onto a Photography Tour, Workshop or Tailor Made Tour based on the suitability on the individual due to fitness and/or health levels required.

Photography: We reserve the right to take photographs or videos during the operation of any tour or part thereof and to use the resulting photography, videos, or recordings for promotional or commercial use. By making a reservation on a TWI Photography Tour, Workshop or Tailor Made Tour, the participant agrees to allow his/her likeness to be used by TWI, TWI-authorized third parties, and the Tour Operator without compensation to the participant. If the participant prefers that his/her likeness not be used, he/she must notify us in writing prior to departure of the trip. Copyright in all photographs, video, and related materials created by the participant (“tour Materials”) shall belong to the participant upon creation. The participant grants to TWI a non-exclusive, worldwide, irrevocable license to use any tour Materials provided to TWI and/or the Tour Operator in any media for the following limited purposes: editorial use, promotion of this editorial use, promotion of TWI travel programs, or promotion of the mission of TWI.

Force Majeure: TWI will not be liable for any delay in, change to or cancellation of trips due to ‘Force Majeure’. ‘Force Majeure’ means a circumstance beyond the reasonable control of TWI and includes, but is not limited to, war or threat of war, riot, civil strife, terrorist activity, industrial dispute, disease, industrial or nuclear disaster, adverse weather conditions, fire and strikes.

Dispute Resolution: If the participant has a complaint, he/she should first inform the adventure leader while on the adventure so that the adventure leader or tour operator can attempt to rectify the matter. If the participant is still dissatisfied, he/she should submit the complaint in writing to TWI within 30 days of the completion of the adventure.

Other: Other Terms and Conditions may apply to some tours and will be provided with pre-trip emails or mailings. By registering for a TWI Photography Tour, Workshop or Tailor Made Tour, the participant agrees to the Responsibility statement and the Terms and Conditions herein.

Private Payments: Tailor Made Photo Tours are payable in GBD pound sterling only via PayPal. A 50% deposit is required at the time of registration to secure your Tailor Made Tour.  Your balance is due 180 days (6 months) prior to the start date of the Tailor Made Photo Tour.

Private Cancellations: Cancellations made up to 181 days before a Private Photo Adventure start date are fully refundable. Cancellations made between 180 and 121 days are 50% refundable (total trip price). Cancellations made within 120 days of the trip date are non-refundable.
